PROJECT: Treatment Plant 7 Modifications

BIDS RECEIVED

Elk River Municipal Utilities, Elk River, Minnesota, will receive sealed bids until 11:00 A.M. Tuesday, October 20, 2026, to furnish Labor and Material to construct the Treatment Plant 7 Modifications as more fully described in the specifications. Bids will be opened and read at that time at the address noted below.

Bids can be sent by email with the subject line indicating: Bid for Treatment Plant 7 Modifications. The bid should be provided in an attachment to the email with no bid details provided in the body/text of the email other than contractor information. The attachment will not be opened until the designated bid opening time.

If the bid is submitted by email the attachment should include the executed Bid Form and Responsible Contractor Certification Forms. If the bid is submitted by mail or in person, the Bid Form and Responsible Contractor Certification Forms should be contained within a sealed envelope.

DESCRIPTION OF PROJECT

The Treatment Plant 7 Modifications project in the City of Elk River consists of demolition, relocation of existing equipment, and installation of new piping as indicated in the plans and specifications to allow for the treatment of water from Well Number 8.

LATE BIDS

Bids received after the time set for the opening of the bids will be returned to the bidder unopened.

REJECTION OF BIDS

The Elk River Municipal Utilities Commission reserves the right to reject all bids and waive all technicalities. The project will be awarded to the lowest responsible and responsive bidder.

PROJECT AWARD

It is Elk River Municipal Utility’s intent to award the project at their regularly scheduled meeting in November 2026 and the project must be completed by March 31, 2027. Once the Contractor has mobilized on site, work shall continue without interruption until the Improvements are completed and accepted. The Utility reserves the right to award within 60 days of the bid opening.

SPECIFICATIONS

Electronic plans and specifications detailing the work are attached and should be reviewed prior to submitting a bid.

BOND / LETTER OF CREDIT

The successful bidder must, at the time of the execution of the contract, provide Elk River Municipal Utilities a performance and payment Bond or irrevocable letter of credit pursuant to the requirements of Minnesota Statutes Section 574.26 to 574.32, as amended.

INTENT OF SPECIFICATIONS

The specifications are intended to describe the type of material and general features of design required. No substantial or material deviations from specifications, alterations or substitutions will be considered.

NON-COLLUSIVE BIDDING CERTIFICATIONS

By the submission of a bid, the bidder certifies that: (a) The bid has been arrived at by the bidder independently and has been submitted without collusion with any other vendor of materials, supplies, or equipment of the type described in the invitation for bids; and (b) The content of the bid has not been communicated by the bidder, nor to its best knowledge and belief by any of its employees or agents to any person not an employee or agent of the bidder or its surety on any bond furnished herewith, and will not be communicated to any such person prior to the official opening of the bid.

LIQUIDATED DAMAGES

Owner and Contractor recognize that the Owner will suffer financial loss if work is not completed within the time specified in the Specifications and Letting, plus any extensions thereof allowed. They also recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by the Owner if the work is not completed on time. Accordingly, instead of requiring any such proof, the Owner

and Contractor agree that as liquidated damages for delay (but not as a penalty) the Contractor shall pay the Owner Five Hundred Dollars ($500.00) for each day that expires after the time specified in the Specifications.

ENGINEER’S AUTHORITY

The Engineer may act as the Owner’s representative during the construction period and may decide questions which may arise as to quality and acceptability of materials furnished and work performed, and shall interpret the intent of the Contract Documents in a fair and unbiased manner. The Engineer will make visits to the site and determine if the work is proceeding in accordance with the Contract Documents.

The Contractor will be held strictly to the intent of the Contract Documents in regard to the quality of materials, workmanship, and execution of the work. Inspections may be at the factory or fabrication plant of the source of material supply. The Engineer will not be responsible for the construction means, controls, techniques, sequences, procedures, or construction safety.

The Engineer shall promptly make decisions relative to the Contract Documents and his decision shall be final.

PERMITS

A permit has been received from the Minnesota Department of Health. Coordination with the Department of Health to permit required inspections will be required as part of the project scope.
